NJECPAC is a Continuing Political Committee (CPC). A CPC is any group of two or more persons acting jointly, or any corporation, partnership, or any other incorporated or unincorporated association, civic association or other organization, which in any calendar year contributes to aid or promote the candidacy of an individual, or the candidacies of individuals, for elective public office, or the passage or defeat of a public question or public questions, lobby for the passage or defeat of certain legislative bills introduced in the NJ Legislature in accordance with N.J.S.A. 19:44A-8(b). A CPC is frequently referred to as Political Action Committee (PAC). The NJECPAC was formed to provide funding for legislative initiatives of its members and its member organizations representing the interests of Electrical Contractors, Small Businesses and Taxpayers throughout the State of New Jersey.

Solar Energy Rescue Bill Awaiting Governors Action

The NJ Assembly and Senate has sent a bill (S-1925) designed to rescue the floundering Solar Industry from collapsing. Assemblyman Bob Smith explained: "We are a victim of our own success. We've had so much solar built in New Jersey and so many SRECs available that the market for these Solar Renewable Energy Credits (once selling at $600 and now under $100 per credit) has crashed and there are lots of unintended consequences."  Read Senate Floor Statement


Among those unintended consequences:

1. Public entities caught in a squeeze - Counties and municipalities contracting for the installation of solar energy projects are finding that the SREC prices are not high enough to repay the public bonds floated to finance the projects. If a project already is under way, taxpayers are stuck with the bill for the shortfall. If a project has not yet started, it likely will never get off the ground.

2. Negative future for private projects - Bankers often look at SRECs as collateral, providing them with the confidence to lend money for construction. If the fluctuating value of the solar credit cannot be relied upon to remain sufficiently high over the life of the loan, banks won't take the risk.

The bottom line is what Smith describes as a "crisis." Without a prompt legislative solution to stabilize solar credits, the market will dry up and scores of solar-installation companies will fail and jobs will be lost.

Business organizations worried about costs; Representatives of the NJ Business and Industry Association, NJ Chamber of Commerce, and the Chemistry Council of NJ, cautioned against additional government mandates that would drive New Jersey's already high energy prices even higher.

Noting that the program will reach $190 million by 2016--and that the state's largest employers will bear 60 percent of that cost--the Chemistry Council's Hal Bozarth said: "At some point the Legislature has to say to the solar industry: we're cutting you loose."

Our View: The so called Solar Industry has been a thorn in the side of Electrical Contractors since its inception. Many Solar Energy Contractors are not Electrical Contractors as the 1962 Electrical Contractors Licensing Law dictates. 

Many Unlicensed Solar Contractors  violate the law day in and day out. In fact every time they install Solar Panels utilizing their employees who are not Licensed or qualified to do so they commit a Felony in the State of New Jersey. 

These Solar Contractors sub contract Licensed Electrical Contractors only to make the final connections, and they would not do that if the Electrical Industry did not engage the help of the Electrical Licensing Board and Electrical Inspectors across the state to ensure the installation of Solar Panels work is done by Licensed Contractors. The Electrical Contractors that are accepting this work are hurting the very industry in which they make their living. The Electrical Contractors enabling these violations are Not Electrical Contractors that run Professional Electrical Contracting Businesses In the State of New Jersey.  

At some point the Solar Industry will have to stand on its own two feet. Cost for Solar Panels and equipment will not come down to more affordable levels until Solar subsidies are eliminated.

Roberts, May Have Slyly Handed Election To Romney

As you have no doubt heard by now, the Supreme Court largely upheld Obamacare with Chief Justice John Roberts writing the majority 5 to 4 decision. Even Justice Kennedy called for the whole law to be thrown out, but John Roberts saved it.


John Roberts is playing at a different game than just about everyone else. While most are viewing a poker hand. He’s playing chess. 


Although we believe the concern is invalid, Roberts is concerned about keeping the Supreme Court above the partisan fray and damaging the Courts reputation


Roberts written opinion forces everyone to deal with the issue as a political, not a legal issue.


Roberts has expanded Congresses taxation power. By blocking the Commerce clause as an avenue for Congressional overreach, he has affirmed the Democrats are massive taxers.


Roberts opinion forces everyone to deal with the Health Care problem politically. Democrats are going to have a hard time running up to November claiming the American people need to vote for them to preserve Obamacare. The Law remains very unpopular with the American people. A vote for Health Care is now a vote for keeping a massive tax increase, we can not wait to see how that works out for them. 


Roberts decision also totally removes a growing left-wing talking point. Suddenly voting for Obama because of Supreme Court judges in November issue is gone. 


If they do not squander it Congressional Republicans have been handed an opportunity to try to shut down the individual mandate thereby Forcing Democrats on the record about the mandate. 


60% of Americans still agree with Republicans on the issue. The Democrats will continue claiming that individual pieces of Obamacare are quite popular. With John Roberts’ opinion, the repeal fight takes place on GOP turf, not Democrat turf. The all or nothing repeal has always been better ground for the GOP and now John Roberts has forced everyone onto that ground. 


It seems very, very clear to me in reviewing John Roberts’ decision that he is playing a much longer game, and can afford to with a life tenure. And he probably just handed Mitt Romney the White House. Read More Here

NJECPAC Protecting NJ Electrical Contractors

We have seen unions being beaten back across the country which in the public sector and for taxpayers may be a good thing however, the consequence could be a focus and strengthening of Construction Labor Unions. 


Unions know that Merit shop construction trades are vulnerable and unorganized. NJECPAC primary focus is Electrical Contractors, we predict increased union activity and a rough road ahead for Merit Shop Electrical Contractors that will be forced to defend themselves against union organizing attempts. 

In NJ there are many separate Electrical Contractor Associations however, the large majority of Merit Shop Electrical Contractors do not belong to an Association, which leaves them out in the cold with no protection when they are targeted by a union. 

Another issue that is easily corrected is Organizations that do exist primarily focus on mandated Continuing Education and not much more. The leading organizations know the importance being active in Government and Regulatory Affairs and are members of NJECPAC.    

NJECPAC is the common thread protecting Merit Shop Electrical Contractors in NJ against egregious Legislation and Regulations coming from Trenton. Local Electrical Contractors Association squandered an opportunity to protect their members when they rejected a merger with an Association that works diligently to protect their interests in NJ and also in Washington DC. Power and influence comes with numbers.

Every NJ Electrical Contractor has an obligation to their industry and the survival of their own business to be members of the strongest Association(s) in the State.  A good place to start is with a NJECPAC member Association. 

NJECPAC Member Associations are the leaders in New Jersey providing Education in Government & Regulatory Affairs, Credibility & Strength to NJ's Electrical Contractors. Strong Associations provide their members with the ability to protect themselves from unscrupulous union organizing activity, damaging Legislation, and Regulations, all of which can put them out of business before they know what happened.

Stalling Economic Recovery 


The Bureau of Labor Statistics this week reported a significant drop in job openings, indicating America’s employers are hesitant to invest in and expand their businesses. Adding insult to injury, economists at Stanford University and the University of Chicago released a new chart on Tuesday showing economic uncertainty has shot up in recent months, a trend these economists have previously noted may stem from costly federal policies:

When businesses are uncertain about taxes, health-care costs and regulatory initiatives, they adopt a cautious stance.  Because it is costly to make a hiring or investment mistake, many companies will wait for calmer times to expand. If too many businesses wait, the recovery never takes off.

Instead of changing course and working with Republicans to reduce federal burdens and provide certainty to our nation’s job creators, the Obama administration continues to advance policies that discourage employers and harm job growth. Here are just two examples of federal policies that are stalling our economic recovery and having a chilling effect on America’s workforce: a government takeover of health care and an aggressive and job-destroying labor board.  Read More.

Unions Dealt Another Blow

Labor Unions were dealt another blow yesterday by the Supreme Court in a ruling that stated that unions must inform their members of the intended use of dues assessments in particular when they are used for political activities providing an employee the opportunity to opt out. 

We have seen the failure of the unions’ in the Wisconsin recall attempt, Failure when a Federal Judge shot down the NLRB's mandatory posting requirement, and another Federal Judge shot down the NLRB's Micro Election rule which if implemented would allow unions to organize portions of a company, for example, in the construction industry Apprentices could be organized without organizing the rest of a company. 

Labor groups in Michigan are attempting to get a state amendment placed on the November ballot designed to guarantee the right to collective-bargaining for government and private-sector workers. If this is defeated in Michigan, one of the most unionized states in the country, 49 other other states could move to bring unions under control there, too.

Other states likely to make the next move in curtailing the power of Big Labor are Missouri, Minnesota, New Hampshire, New Mexico, Iowa and Pennsylvania.

The labor movement itself is stumbling forward, trying to find scapegoats while licking their wounds and clambering to stop their losses. Some steps that unions are taking are changing their leadership, mergers, and signing up the unemployed

Meanwhile, Big Labor will continue to point to “union-busters” as the cause of all their problems, rather than their lack of relevance in meeting the needs of today’s employees or the fact that they are killing the companies they organize.

Obama’s NLRB Unleashes Ambush Elections on Your Business

On Monday, April 30th, Barack Obama’s union-controlled National Labor Relations Board will be imposing its new union election rules, designed to ambush employers. Unions won over 71% of the 1595 NLRB-conducted elections in 2011 which makes one wonder why this rule is even warranted and is certainly unnecessary. 


Given unions’ legal ability to deceive workers into unionizing, NLRB’s new rule amounts to nothing less than a Government Agency doing big Labors bidding. The increased union organizing activity that is expected to follow will result in smaller companies and their employees being victimized by unscrupulous union organizers.  Read More

Note: This is a different issue from the NLRB Poster Requirement which originally was also to take effect April 30 but has been postponed indefinitely.

A shortened time frame squeezes small business owners, who typically lack the resources and legal expertise to navigate and understand the union election process.

In addition, this rule deprives employees of the ability to hear from their employer before making a decision about union representation. As a result, employees will very likely not have all the facts about union organizing before having to cast their vote for or against union representation.

In addition, last week IEC members from across the Country converged on Capitol Hill for the IEC Legislative Fly-In and urged support for a resolution in the U.S. Senate that would have blocked the rule. The resolution failed on a 54-45 party-line vote.
