DISCLOSE ACT Fails Cloture Vote In Senate

The so called DISCLOSE Act, backed by the President and narrowly passed by the House last month, was blocked in the Senate. The measure would have required CEOs and Business Groups, including Trade Organizations, to appear in ads they fund and require them to reveal their donors.

 

While sold as a means to crack down on the powers of special interest groups, it instead turned out to be a means to stifle traditional Republican supporters while placing virtually no restrictions on traditionally Democratic allies such as big money unions. 

Senate Majority Leader Mitch McConnell, opposed the legislation, which he said purports to promote transparency but is "aimed at one thing and one thing only ... protecting incumbent Democrats from criticism ahead of November."  The measure would also have protected a number of incumbent Republicans.

The DISCLOSE ACT would directly effect groups such as The Coalition For A Democratic Workplace and other issue based groups to which many of our NJECPAC member Associations belong.

Passage of DISCLOSE Act an Assault on Freedom of Speech

U.S. Chamber of Commerce President Thomas J. Donohue issued the following statement on House passage of the DISCLOSE Act:

“The Democratic majority in the House jammed through a piece of legislation that clearly violates the Constitution, as well as basic principles of fairness and equity. The Supreme Court calls it ‘viewpoint discrimination,’ and every first-year law student knows that it’s illegal.

"They only achieved passage of this bill by making backroom deals and exempting some of the most powerful special interest groups in the country—and specifically allowing unions to mask the movement of their political money.

Incumbent Protection Measure Would Have Silenced Many Trade Associations Efforts to Stop Big Labor’s Card-Check Bill.

The U.S. House of Representatives is expected to vote this week on legislation to restrict the First Amendment rights of employers and their Trade Associations. H.R. 5175, the DISCLOSE Act will limit the constitutionally protected free speech rights of small business owners by imposing strict restrictions on campaign spending.

Trade associations would be drowned in red tape and exposed publicly if they attempted to educate voters about key issues being debated by Congress, such as card-check or the recently passed health care law, H.R. 3590.
